Sponsorship Terms and Conditions

  1. Your use of our site means acceptance of Terms & Conditions

    My Acre of Africa Management (Proprietary) Limited, its employees, servants, agents and affiliates (collectively "the Company") will allow you to use this web site, which is administered by the Company and will allow you to transact on this website for the benefit of My Acre of Africa Trust, a trust established as a public benefit organisation ("the Trust"), subject to the terms and conditions of use ("the terms and conditions"). By using this web site in any way, you unconditionally accept all the terms and conditions. Do not use this web site if you disagree with any of the terms and conditions. Your sponsorship of a brick will be subject to the terms and conditions.

  2. Charges for accessing the web site

    The Company does not charge for your use of this web site, but please be aware that local telephone charges by your local telephone supplier or network may apply.

  3. To use the web site, you must be at least 18 years old, or be accessing the web site under supervision

    You must be at least 18 years of age to use this web site. If you are not at least 18 years of age, or if under 18, you may only access and use this web site with full parental/guardian consent.

  4. Information on this web site

    4.1 The information on this web site is there to enable you to partake in the My Acre of Africa fund-raising initiative only and does not constitute advice or a recommendation of any nature.
    4.2 You must not enter into any transactions, or incur any loss or liability based partly or wholly on any information contained in or displayed on this web site or on any web site to which this web site may provide a link, except as may be otherwise envisaged in such web sites.
    4.3 Any views or statements made or expressed on this web site are not necessarily the views of the Company or the Trust.
  1. Payment

    You may make your sponsorship by way of credit card. The Trust recognises payment with the following credit cards: VISA, Mastercard, American Express and Diners Card ("the payment cards"). You authorise the Trust to debit the total amount of the sponsorships due by you, after you have made your final selection of representative bricks and/or tiles, against the payment card. By submitting your payment card details you warrant that you are over the age of 18 (eighteen) years old or are authorised to make the payment with the payment card, and that you have sufficient funds available to make the sponsorship to the My Acre of Africa Trust. You acknowledge that because no goods or services are involved in the sponsorship payment, no refund can be made after the transaction has been authorised and your payment card has been debited.

  2. Currency fluctuations

    This web site is domiciled in the Republic of South Africa and the payment currency is South African Rands. Where the sponsorship amounts are designated in United States dollars, the currency conversion will be performed at the rate of exchange ruling at the time the payment is authorised. Because the processing of the payment through the credit card company could take up to 48 hours, a minor fluctuation may arise between the designated amount authorised and the final amount debited to the payment card.

  3. Intention of the Trust

    7.1

    When you sponsor an acre of Africa represented by a brick, as part of the My Acre of Africa fund-raising initiative ("the sponsorship"), your sponsorship is a charitable contribution to the Trust which has as its main purpose the financing of conservation and conservation education projects initiated in Southern Africa on behalf of South African National Parks.

    7.2  It is the intention of the Trust, for each separate sponsorship that you make, to lay a brick or a granite tile, engraved with the personal inscription of your choice, in My Acre of Africa’s Environmental Education Facility that is to be constructed just inside the western boundary of South Africa's world famous Kruger National Park.
    7.3 As a further acknowledgement of your support, it is also the intention of the Trust to ensure that each person whose name is inscribed on a representative brick will receive, via surface mail, for each sponsorship of one acre of Africa, a personalised commemorative certificate of thanks from Dr Nelson Mandela, the former president of South Africa, who is the Patron Emeritus of the Trust.
    7.4 The creation of the Environmental Education Facility in the form envisaged in the website is subject to the final completion and acceptance of an Environmental Impact Assessment of the proposed location within the Kruger National Park (final Record of Decision approving the EIA signed and issued by South Africa’s Department of Environmental Affairs & Tourism on 13 October 2003), and the raising of sufficient funds by the Trust to complete and maintain the Facility.
    7.5 Notwithstanding the disclaimers contained in these terms and conditions, the Company and the Trust shall use commercially reasonable endeavours to fulfil the representation made in the website to which these terms and conditions apply. You recognise that the overriding objective of the My Acre of Africa Project is to raise funds for the Trust, to be disbursed, and used for conservation projects, on the basis set out in 7.7 below. In turn the Company and the Trust shall ensure that the funds raised are diligently and faithfully administered and applied in accordance with the Trust Deed, the terms of which are available in the website to which these terms and conditions apply.
    7.6 All parties recognise and agree that the funds raised by the Trust are public monies and it is incumbent on the Trustees to fulfil their Trust with the highest standard of good faith; and all parties, including the Trust and the Company, commit themselves to the attainment of this objective and the preservation of South Africa's natural heritage.
    7.7 The My Acre of Africa fund raising project is predicated on the support of the general public at a level that will result in sponsorships for a substantial number of bricks being achieved. The current world events have introduced uncertainty as to the future and there is no guarantee that all the bricks will be sponsored. Notwithstanding this uncertainty, the funds raised by the Trust will be applied for special conservation projects, after deduction and disbursement of the costs and expenses referred to in the information section of the web site to which the terms and conditions apply, under the captioned heading “How will my money be used?”
    7.8 Your sponsorship of a brick and your transaction on the web site does not confer any property or other rights on you in relation to any bricks which may be laid in the Kruger National Park or elsewhere, or in relation to any other aspect of the My Acre of Africa project as set out in the web site. Accordingly, and subject only to 7.5 above, you shall have no claim of any nature whatsoever and howsoever arising against the Trust or the Company in relation to the My Acre of Africa project, including as to the date or time within which any bricks may be laid, or if your brick is not laid in accordance with your transaction on the web site to which these terms and conditions apply. The Company and the Trust further reserve the right to reject an inscription on any brick for any cause whatsoever.

  4. Disclaimers and indemnities

    8.1

    While the Company and the Trust will attempt to ensure that the contents and information of this web site are accurate and complete, the Company and the Trust do not make any representation or warranty, whether express or implied, as to the operation, integrity, availability or functionality of this web site or as to the accuracy, completeness or reliability of any information on this web site.

    8.2  If you rely on this web site or on the information contained in this web site, you do so at your own risk.
    8.3 The Company and the Trust make no warranty or representation, whether express or implied, that the information or files available on this web site are free of viruses, destructive materials or any other data or code which is able to corrupt, compromise, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation of a computer system, computer network or your hardware or software. You accept all risk associated with the existence of such viruses, destructive materials or any other data or code which is able to corrupt, compromise, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation or content of a computer system, computer network or your hardware or software.
    8.4 The Company and the Trust do not accept any responsibility for any errors or omissions on this web site.
    8.5 Although the Trust will exercise all reasonable care and diligence in the processing of sponsorships by way of a credit card, the Trust does not, subject to any statutory requirements, accept responsibility for any loss or damage that may occur to the person or entity, whether directly or indirectly, making the sponsorship due to the occurrence of a fraudulent transaction with any details of the credit card so used, or otherwise.

  5. Exclusion of liability

    The Company and the Trust will in no way be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from the use of, or reliance upon, any material or content contained in the web site or any linked web sites, even if the Company and/or the Trust has been advised of the possibility of such loss, expense, claim or damages. You hereby indemnify the Company, the Trust and their employees, servants and agents and agree to keep indemnified the Company and the Trust against any such loss, claim or damage which may be suffered by them or any third party arising in any way from your use of this web site.

  6. Intellectual property rights

    The contents, information and material on this web site, including (without limitation) any software, icons, text, links, graphics, images, sound clips, trade names, logos, trade marks, service marks, whether registered or not, are protected by South African and international law, including but not limited to copyright, patent and trade mark law, and belongs to the Company and/or third parties ("the intellectual property"), which have given their permission for the use of such intellectual property by the Company. Any unauthorised use of the intellectual property is prohibited.

    11.1 The Company and the Trust do not endorse and are not responsible or liable for the contents, maintenance of, or activities conducted on, any web site to which this web site provides a link.

    The Company reserves the right to update and/or amend the terms and conditions from time to time and without any notice. Any such change will only apply to your use of this web site after the change is accessible and may be viewed on this web site. If you use this web site after such updated or amended terms and conditions have been made accessible or can be viewed on this web site, you will be deemed to have accepted such updates or amendments.

  2. Governing law & Jurisdiction

    Subject to the paragraph below, the terms and conditions will be governed by, and interpreted in accordance with the laws of South Africa, and you irrevocably agree that the courts of South Africa will have exclusive jurisdiction to settle any dispute that may arise out of, under, or in connection with these terms. The Company may in its discretion launch proceedings in the courts of your country of residence, or domicile, or where these terms and conditions are entered into in the course of your trade or profession, the country of your principal place of business.

  3. Termination and Amendments

    The Company may in its sole discretion terminate, suspend and modify this web site and/or your use of this web site, with or without notice to you. You agree that the Company and the Trust will not be liable to you in the event that the Company chooses to suspend, modify or terminate this web site or your use of this web site.

  4. Severability

    If any one or more of the provisions of these terms and conditions should be held to be invalid or unenforceable, the validity and enforceability of all the other provisions of these terms and conditions will not be affected thereby and will continue in full force and affect.

  5. Interpretation

    In these terms and conditions:

    17.1 the headings of clauses will not be used in the interpretation of these terms and conditions;
    17.2  unless inconsistent with the context, words or phrases which are defined will bear the meaning assigned to them;
    17.3 unless inconsistent with the context, words referring to:
      17.3.1 one gender include a reference to the other genders;
      17.3.2 the singular include the plural and vice versa;
      17.3.3 natural persons include artificial persons and vice versa.
